GENERAL CONSUMER TERMS

These Consumer Terms (“Terms”) apply to recipients of payout orders (“Orders”) processed through the Pin4 platform. By accessing, attempting to redeem, or redeeming an Order, you agree to these Terms and any applicable Service Terms for your selected payout method.

1. Role of Pin4

Pin4 provides technology and authorization services to enable payout of Orders issued by an authorized entity (the “Sending Entity”). Pin4 does not hold customer funds, does not issue electronic money, is not a bank, and does not provide money transmission services to recipients. Funds are made available by the Sending Entity and/or its regulated partners.

Nothing in these Terms creates any partnership, joint venture, agency, fiduciary, or employment relationship between you and Pin4.

2. Eligibility and Verification

You must be legally permitted to receive funds in the payout country and must provide accurate information. Additional information may be required to comply with legal, regulatory, fraud-prevention, or sanctions-screening requirements. If verification fails or required information is not provided, redemption may be delayed or declined.

3. Orders; Expiration; Cancellation

Orders may be redeemed only once and only in the full amount prior to the stated expiration date. Orders may be cancelled or suspended at the discretion of the Sending Entity or if required by law or if fraud, misconduct, or suspicious activity is suspected. Expired or cancelled Orders have no value.

4. Credentials and Security

You are responsible for safeguarding your Credentials (including phone number, order number, secret code, and/or reference number). Loss, disclosure, or misuse of Credentials may result in unauthorized redemption. None of Pin4, the Sending Entity or our regulated partners are responsible for losses resulting from your failure to maintain the confidentiality of your Credentials.

5. Communications and SMS Consent

By providing your mobile phone number or accessing an Order, you consent to receive transactional communications from Pin4 and/or the Sending Entity in connection with the Order. These communications may be delivered by SMS text message, email, or other electronic means and may be sent using automated technology.

SMS messages may include Order details, reference numbers, expiration reminders, security notifications, and other service-related information. Message and data rates may apply. Message frequency will vary.

You may opt out of SMS messages at any time by replying “STOP” to a message; however, opting out may prevent you from receiving necessary information required to redeem an Order. You represent that you are the authorized user of the mobile number provided and have authority to consent to receive messages at that number.

Pin4 and Sending Entities are not responsible for delayed or undelivered messages caused by carrier issues, phone issues, network availability, or incorrect contact information.

6. Disputes and Transaction Records

You must contact the Sending Entity first for any issue relating to an Order. Transaction records maintained by the relevant payout partner, network, ATM operator, or retail agent are the definitive record for resolving disputes. Your sole and exclusive remedy for a valid transaction error is reissuance of the Order or reimbursement of the applicable amount, as determined by the Sending Entity in accordance with applicable law.

7. Disclaimer of Warranties; Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIN4, THE SENDING ENTITY AND OUR REGULATED PARTNERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL PIN4, THE SENDING ENTITY OR OUR REGULATED PARTNERS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Availability and Force Majeure

Payout services depend on third-party networks, payout agents, ATM operators, and infrastructure. Availability, limits, payout methods and requirements may vary by country and location. Pin4 does not guarantee uninterrupted access or availability.

Pin4 shall not be responsible for delays or failures caused by events beyond its reasonable control, including governmental actions, sanctions restrictions, network outages, labor disruptions, or other force majeure events.

9. Privacy

The Sending Entity is the controller of your personal data for purposes of providing the service. Additional information regarding how personal data is processed is set forth in the Pin4 Privacy Policy, available here. You authorize the Sending Entity to share your personal data with Pin4 and other participating entities as necessary to operate the service, prevent fraud, and comply with legal requirements.

10. Claims Period; Severability

Except where prohibited by applicable law, any claim relating to an Order must be brought within the time frame specified by the Sending Entity and, in any event, within one (1) year after the event giving rise to the claim.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

11. Changes to These Terms

Pin4 may modify these Terms for legal, regulatory, security, or operational reasons. Updated Terms will be made available through the applicable website or web application. Material changes will apply only to new Orders and, where required by law, will be effective no earlier than thirty (30) days after notice is provided.

ATM CASH PICKUP SERVICE TERMS

These terms apply if you redeem an Order at a participating ATM. You must enter the required Credentials at a participating ATM prior to expiration. If valid, the ATM will dispense the full Order amount. ATM availability, cash levels, and functionality are not guaranteed. ATM operator records are the definitive transaction record in the event of a dispute.

RETAIL CASH PICKUP SERVICE TERMS

These terms apply if you redeem an Order at a participating retail payout location. You may be required to access a web application to enter Credentials and provide additional information. If a currency exchange applies, the exchange rate will be presented prior to submission and will be final upon acceptance.

You must present a reference number and valid government-issued identification at the retail location. The name on your identification must match the Order details. Retail agents may refuse payout if identification requirements are not satisfied. Retail agent and payout network records are the definitive transaction record.

UNITED STATES SUPPLEMENT

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

ARBITRATION AGREEMENT: Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the county of your residence or another mutually agreed location. Arbitration shall be conducted on an individual basis only. You waive any right to participate in a class, collective, or representative action.

JURY TRIAL WAIVER: TO THE EXTENT A DISPUTE IS PERMITTED TO PROCEED IN COURT RATHER THAN ARBITRATION, YOU AND THE SENDING ENTITY EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.

If you are a resident of California, nothing in the Arbitration Agreement prevents you from seeking public injunctive relief in a court of competent jurisdiction as permitted under California law.

You may opt out of arbitration by providing written notice to the Sending Entity within thirty (30) days of first accepting these Terms.

UNITED KINGDOM SUPPLEMENT

These Terms are governed by the laws of England and Wales. Nothing in these Terms shall exclude or limit any statutory rights you have under the Consumer Rights Act 2015 or other applicable UK consumer protection laws.

If the Sending Entity is authorised and regulated by the Financial Conduct Authority and you are not satisfied with the resolution of your complaint, you may have the right to refer your complaint to the Financial Ombudsman Service. Electronic money services are not covered by the Financial Services Compensation Scheme.

EUROPEAN ECONOMIC AREA SUPPLEMENT

Mandatory consumer protection rights of your country of residence apply. Nothing in these Terms limits or excludes rights granted to you under applicable EU consumer protection legislation.

REST OF WORLD SUPPLEMENT

These Terms are governed by the laws of the country identified by the Sending Entity. Mandatory local consumer protection laws apply where required and will prevail over conflicting provisions of these Terms.
